1. Assumption of Risk
Use of the golf simulator, hitting bay, golf clubs, balls, and related equipment ("the Simulator") involves inherent risks, including but not limited to: being struck by a golf club or ball, ricochets, slips, trips and falls, muscle strain, and property damage. By using the Simulator, each guest voluntarily assumes all risks of injury, death, or property damage, whether caused by negligence or otherwise.
2. Release and Waiver
In consideration of being permitted to use the Simulator, the guest — on behalf of themselves, their family members, minor children, invitees, heirs, and assigns — releases, waives, and forever discharges the property owner and host of The Green Bunker, and their agents and representatives ("the Host"), from any and all claims, demands, causes of action, or liability of any kind arising out of or related to use of the Simulator, to the fullest extent permitted by law.
3. Indemnification
The guest agrees to indemnify and hold the Host harmless from any claims brought by any member of the guest's party, including minors, arising from use of the Simulator.
4. Supervision of Minors
Guests under 18 may use the Simulator only with direct adult supervision. The supervising adult accepts full responsibility and all risk on the minor's behalf.
5. Condition of Equipment
The Simulator is provided "as is." The Host makes no warranties regarding the equipment. The guest agrees to follow all posted house rules, use only the provided indoor balls, and to clean any personal clubs before bringing them into the simulator room (house clubs are provided by the cabinet). Shoes are not provided: guests must wear clean indoor shoes or socks on the hitting turf. The side door of the simulator room must not be used except in an emergency. Dirt or debris from unclean clubs, balls, or footwear permanently stains the impact screen; a stained screen cannot be cleaned and requires full replacement, the cost of which will be invoiced to the guest. The guest is responsible for the cost of repair or replacement of any equipment damaged through misuse.
6. Security Deposit Authorization
No deposit is collected upfront. By accepting this agreement, the guest authorizes the Host to charge the payment method used for this purchase, and/or to seek payment through the Airbnb Resolution Center, up to $2,000 for the reasonable cost of repairing or replacing equipment damaged through misuse, violation of the house rules, or use of the side door in a non-emergency. Any such charge will be itemized, supported by photos and repair or replacement receipts, and communicated to the guest within 7 days of checkout. If the simulator room and equipment are left in good condition, nothing is charged.
7. Medical Fitness
The guest represents that they and their party are physically able to participate and will not use the Simulator while impaired by alcohol, drugs, or medication.
8. Acceptance
Checking the acceptance box and completing payment constitutes the guest's electronic signature and agreement to these terms on behalf of their entire party, and applies for the full duration of their reservation.
